The man driving the Suzuki and the woman in the front passenger were not wearing seat belts and both died at the scene.
The 1-year-old child that was in the back of the Suzuki remains in critical condition as of Friday afternoon, according to Valley Children's Hospital.
Mr. Martinez was taken to Community Regional Medical Center with major injuries.
CHP says Mr. Martinez was suspected of driving while under the influence of alcohol and was placed under arrest for felony DUI causing injury and death.
A 1-year-old is critically injured and two people are dead after a car crash in Madera County.
