UPDATE:The man shot and killed Saturday in Fresno during a Super Bowl-related argument has been identified as 24-year-old Frank Rojas of Fresno.

Police say Rojas was talking to two men when they were approached by 35-year-old Daniel Gonzalez, a documented Playboy Sureno gang member.

Police say Gonzalezmistook the victim and his friends as opposing gang members because of the San Francisco 49ers flag outside the residence.

Neither the victim nor his friends are associated with gangs and they were simply celebrating their team’s trip to the Super Bowl.

The men started arguing and Gonzalez pulled an improvised firearm known as a Zip gun and fired one shot, hitting Rojas.

Gonzalez ran from the scene but was picked up by officers a short time later.

Police say Gonzalez was on probation and was staying at a nearby homeless encampment.

A man in southwest Fresno was shot just before noon Saturday after an argument with a man on a bicycle over the Super Bowl, according to the Fresno Police Department.

Around 11:50 AM the Fresno police department received a 911 call that a man had been shot in the area of Tuolumne and B street.

When officers arrived, they found a man in his 20's with a gunshot wound to his abdomen.

The man told police that a homeless man on a bike came up to where they were having a barbecue and started an argument over his 49ers flags and decorations.

At some time during the argument, the suspect pulled what police are calling a makeshift gun out of his backpack and shot the victim in the stomach.

The victim was taken to Community Regional Medical Center where he is undergoing surgery. His condition was not known at the time.

Officers quickly set a perimeter and located the suspect with witnesses help at a nearby homeless encampment, taken into custody.
